Thank you for using our product, and associated services (hereinafter, the product). The product and service is provided by Joe Data Services Pvt. Ltd., located at 4A, Mangal Graha Apartments, Third Panchayat Link Road, Perungudi, Chennai 600096.

By using our product, either on the website, or through the Smart CityTracker mobile application, you are agreeing to be bound by these terms of service. You agree that these terms of service may be revised at any point of time and notified to you, and that your continued use of the services will be governed by such revised terms.

You agree that you will use the Product only as permitted by law. You also agree that you will not misuse the product, or access it in any manner contrary to the instructions that we provide. You agree that we may suspend or stop providing access to the Product if you do not comply with these terms of service or if we are investigating suspected misconduct. If you are not legally capable of entering into a contract under the Indian laws, please do not use this website.

You agree that your subscription to this Product entitles you only to use the product yourself, and that you will not share the login and other details that allow them to access this service with any other person

What we provide

SmartCityTracker aims to accumulate and analyse publically available data about the cities in India chosen to be part of the Smart City Project of the Government of India. The data that we work on originates from different sources. This could be either public records maintained by the government or a Government company, or public data as published by a private-sector enterprise, or in some cases, non-public company that we obtain from specific companies. Some of our data could be obtained through a query under the Right to Information Act. In each of the above cases, we will highlight the source of the data which we have relied upon in the product. However, consequently, we cannot assure the accuracy of the source data we analyse. That is, if the data provided by the original source is inaccurate, then the corresponding output we provide will also neccessarily be inaccurate to that extent.

Our Product aims to give you the tools to explore and intertpret the data. As a subscriber, you do not acquire any right apart from access to the data. The Intellectual Property rights associated with the product, including the solutions derived therefrom will remain with us. You will however be permited to use the data for business purposes as well as share it for purposes such as marketing or an investor presentation.

You agree that we do not warrant or make any specific promises about the Product. For example, we do not make any commitments on the contents of the Product, its availability, reliability or its ability to meet your requirements.

We may add or remove functionailities in the product or features as part of our commitment to improving the quality of experiences.

Errors and Inaccuracies

We aim to give you a service that is free of any error. However, it could so happen that an error may creep into our Product, either due to wrong input data relied on, or due to a computational error on our part. You agree that you will not use our data as the sole basis for your decision making, and thus, you will not hold us responsible for any losses suffered by you as a result of any error or inaccuracy in the data provided by our product.

Limitation of Liability

You agree that to the furthest extent permitted by law, except for any indemnification obligations hereunder, or your breach of intellectual property rights, confidentiality rights, and/or proprietary interests relating to this agreement, in no event shall either party be liable under the agreement for any consequential, special, indirect, exemplary or punitive damages whether in contract, tort, or other theory, even if such party has been advised of the possibility of such damages, and notwithstanding the faillure the the essential purpose of any limited remedy.

You agree that the liability of Smart City Tracker, Joe Data Services Pvt. Ltd., its promoters, and management will be limited to the extent of the subscription amount paid under this contract during the current billing period. You further agree that both parties have entered into this contract relying upon this Limitation of Liability clause, and such limitations are an essential basis for the bargain between the parties.

Indemnity

You agree to indemify and defend Smart City Tracker Joe Data Services Pvt. Ltd., its promoters, and management from and against any and all third-party claims and liabilities arising out of your use of the Product, authorised or unauthorised.

Termination

These Terms of Service will be applicable to you till this agreement is expressly terminated by either party. You may terminate the agreement at any point by informing us that you wish to do so. However, all obligations and liabilities incurred prior to the date of termination shall survive the termination of the agreement.

Privacy

The use of information given to us by you shall be governed by our privacy policy. Our policy is not to sell any information you provide to us to any third party. However, you agree that, where neccessary for legal compliance, we may share personally identifiable data with enforcement authorities. You also agree that if you click on any service provided by a third-party to this agreement, such as a Facebook Like button, for example, you will be bound by their terms and policies, if any.

Amendments

You agree that we may amend these Terms of Service at any point of time, and from that point onwards, you will be bound by the revised terms of service. You further agree that you will be deemed to have been notified of the change by alerting you on the home page of the website at the first instance after the change, or by an update to the mobile appliocation.

Jurisdiction

You agree that this Terms of Service as well as our product will be govered by the laws in force in India, and that any dispute arising therefrom will be subject to the sole jurisdiction of the Courts of Delhi.
